Terms of service.

1. Agreement and eligibility

These Terms are a binding agreement between you and CDM Cuts / Chris Nopy (“CDM Cuts,” “we,” “us,” or “our”). If you do not agree, do not use the website or booking service. You must be legally able to enter into this agreement. If you book for another person, you represent that you are authorized to provide their information and accept these Terms for the booking. A parent or legal guardian should arrange services for a minor when required.

Our Privacy Policy describes how we handle personal information and is incorporated into these Terms.

2. Appointments, changes, and cancellations

• Booking requests: an appointment is confirmed only when the website displays confirmation or CDM Cuts sends a confirmation message. Availability can change until confirmation is complete.
• Accurate information: provide a working email address and phone number and accurate service details. You are responsible for reviewing the service, date, time, and location shown in the confirmation.
• Changes: to reschedule or cancel, reply to the confirmation email or contact @cdm_cuts as soon as possible. A change is not effective until acknowledged by CDM Cuts.
• Late arrivals and no-shows: late arrival may require shortening or rescheduling the service so later appointments are not disrupted. Any cancellation, late-arrival, deposit, or no-show rule specifically displayed during booking or communicated before confirmation also applies.
• Our changes: illness, emergencies, unsafe conditions, equipment problems, or events outside reasonable control may require CDM Cuts to reschedule or cancel. Our remedy is to offer a reasonable reschedule or refund any amount actually paid for an unperformed service.

3. Services, pricing, and payment

Descriptions, durations, and prices shown on the website are estimates and may be updated. Final timing and suitability can depend on consultation, hair condition, requested result, travel, and other circumstances. Any material price change will be communicated before the service begins.

The website does not currently process payment-card information. Payment is handled directly with CDM Cuts using the methods made available at the appointment. You are responsible for agreed charges and any applicable tax. Unless otherwise required by law or agreed in writing, completed personal services are not refundable. If you have a concern, contact us promptly so we can reasonably evaluate it.

House calls

For a house call, you must provide a lawful, reasonably clean, safe, and accessible location with enough space, light, and power if needed. You are responsible for securing access, parking, building permission, and the safety of pets and other occupants. CDM Cuts may decline or leave a location that appears unsafe or unsuitable.

Service expectations

Hair and color results vary with starting condition, prior treatments, texture, growth, maintenance, and the information you provide. Tell Chris about relevant allergies, sensitivities, medications, prior chemical services, scalp conditions, or other factors before service. CDM Cuts may refuse or modify a service when reasonably necessary for health, safety, professional judgment, or lawful operation.

4. Email, calendar, and other communications

By booking, you authorize transactional communications reasonably related to the appointment, including confirmation, reminder, rescheduling, security, review, and customer-care messages. You are responsible for keeping contact information current.

Promotional email is subject to applicable law and may be declined using the provided unsubscribe method or by emailing appointments@cdmcuts.com. Opting out of promotions does not stop necessary transactional messages.

Calendar links and files are provided for convenience. You must verify that your calendar saved the correct time, time zone, location, and details; the booking confirmation remains controlling if there is a discrepancy. The current website does not send automated marketing text messages. If text messaging is offered later, separate consent and applicable opt-out instructions will be provided.

5. Reviews, photos, and submitted content

You retain ownership of comments, reviews, and photos you submit. You grant CDM Cuts a nonexclusive, worldwide, royalty-free license to store, reproduce, and use that content to provide the requested review or customer-care function. We will request additional permission before using an identifiable customer photo in public marketing unless your submission flow clearly states that public use is requested.

You represent that you own or have permission to submit the content and that it does not violate privacy, publicity, intellectual-property, or other rights. Do not submit unlawful, misleading, abusive, or malicious content. Nothing in these Terms restricts your right to give an honest review or report a concern to a government agency.

The CDM Cuts name, logos, website design, copy, graphics, and other site materials are owned by or licensed to CDM Cuts and are protected by applicable law. You may use the site for personal booking and informational purposes, but may not copy, exploit, or falsely imply endorsement without written permission.

6. Acceptable use

You agree not to:

• submit false bookings, impersonate another person, or use information without authorization;
• probe, bypass, disrupt, scrape at unreasonable volume, or attempt unauthorized access to the site, staff portal, database, or email systems;
• upload malware or use the site for unlawful, fraudulent, threatening, or abusive activity;
• interfere with another customer’s booking or use automated means that burden the service;
• misuse calendar, review, or communication links.

We may suspend access, cancel fraudulent bookings, or take protective action when reasonably necessary.

7. Third-party services and links

The site may link to or interact with Google Maps, Google Calendar, Apple Calendar, Outlook, Instagram, public review services, Cloudflare, Resend, and other independent services. Their terms and privacy practices govern your use of them. CDM Cuts does not control and is not responsible for third-party availability, security, accuracy, or conduct.

8. Website disclaimers

To the maximum extent permitted by law, the website and its content are provided “as is” and “as available.” We do not warrant that the website will always be uninterrupted, error-free, secure, or compatible with every device, email client, or calendar service. Photos and examples are illustrative and do not guarantee identical results.

Nothing in these Terms excludes warranties or consumer protections that cannot lawfully be waived.

9. Limitation of liability

To the maximum extent permitted by law, CDM Cuts will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits or data; missed notifications; calendar-provider errors; or losses caused by third-party services or events beyond reasonable control. CDM Cuts’ aggregate liability arising from a particular service or use of the site will not exceed the greater of the amount you paid for that service or $100.

These limitations do not apply to liability that cannot be limited under applicable law, including liability arising from fraud, willful misconduct, or certain personal injuries. Your statutory consumer rights remain unaffected.

10. Governing law and disputes

Before filing a claim, please contact us and give both sides a reasonable opportunity to resolve the issue informally. These Terms are governed by California law, without regard to conflict-of-law rules. Subject to any nonwaivable consumer right, courts located in Santa Barbara County, California will have jurisdiction and venue. Either party may pursue an eligible matter in small-claims court.

11. General terms

We may update these Terms by posting a revised version and changing the effective date. Changes apply prospectively; material changes affecting an existing confirmed appointment will not retroactively reduce rights already earned. We may assign these Terms in connection with a business reorganization or transfer. You may not assign them without our consent.

If a provision is unenforceable, it will be narrowed to the minimum extent necessary and the remaining provisions will continue. A delay in enforcement is not a waiver. These Terms, the Privacy Policy, and any specific terms shown during booking are the entire agreement concerning the site and appointment booking, except for a separate written agreement signed by CDM Cuts.
